PestControlLiability.com (the "Site") is owned and operated by Phil Pavarini Insurance Agent ("Site Owner," "we," "us," or "our"). This Site is an informational and referral resource only. This Site does not sell, bind, or issue any insurance policy of any kind. The Site's function is to provide information about pest control liability insurance and to refer consumers to licensed insurance agents, carriers, and partners who may be able to assist them.

Insurance policies that may result from a referral made through this Site may be issued by Nagashima Pavarini Ltd or by other duly licensed insurance agents, carriers, or partners (collectively, "Insurance Partners"), each acting independently under their own licenses and authority. Phil Pavarini Insurance Agent and this Site are not responsible for any policy issued, modified, denied, cancelled, or administered by any Insurance Partner or other third party.

6. LIMITATION OF LIABILITY AND INDEMNIFICATION

6.1 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PHIL PAVARINI INSURANCE AGENT, NAGASHIMA PAVARINI LTD, PESTCONTROLLIABILITY.COM, AND EACH OF THEIR RESPECTIVE OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND ASSIGNS (COLLECTIVELY, "COVERED PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE, ANY REFERRAL MADE THROUGH THIS SITE, OR ANY INSURANCE POLICY ISSUED OR DENIED BY ANY INSURANCE PARTNER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The total aggregate liability of the Covered Parties to you for any claim arising from your use of this Site shall not exceed the greater of (a) one hundred dollars ($100.00) or (b) any amount actually paid by you directly to PestControlLiability.com in the twelve months preceding the claim.

6.2 No Liability for Insurance Partner Actions

The Covered Parties are not responsible for and shall have no liability arising from the acts, omissions, coverage decisions, underwriting determinations, claims handling, policy terms, exclusions, cancellations, or any other actions or inactions of any Insurance Partner, carrier, underwriter, or issuing agent.

6.3 Indemnification

You agree to defend, indemnify, and hold harmless the Covered Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of this Site, your submission of information through this Site, your reliance on any information contained on this Site, any coverage gap or policy deficiency resulting from your failure to review your issued policy documents, or your violation of this Privacy Policy or our Terms and Conditions.

6.4 Void Where Prohibited

Any offer, product, program, or referral described on this Site is void where prohibited by applicable law or regulation. It is your responsibility to determine whether your use of this Site and any resulting insurance transaction is lawful in your jurisdiction.
